Ex-Pul-i-Charkhi warden, 4 subordinates sent to prison

KABULinfo-icon (Pajhwok): An anti-corruption court on Monday sentenced a former commander of Pul-i-Charkhi Prison and four other jail officials to three years in jail each over deception and misuse of authority.

The primary court of the Anti-Corruption Criminal Justice Center (ACJC) held the open trial attended by the accused, their defence lawyers, government officials, representatives of watchdogs and civil society activists.

The accused included Maj. Gen. Sardar Mohammad Zazai, former Pul-i-Charkhi Prison commander, Col. Mohammad Musa, the prison’s court public relations in-charge, Col. Hashmatullah, 4th block commander, Lt. Col. Mohammad Dawood, 4th block spokesperson, and Sgt. Mohammada Jan, a guard at the 4th block.

Prosecutor Abdul Qadar Sadiq presenting his arguments in the case said the accused had replaced the name of one prisoner with another on the list of a Presidential pardon decree for release.

He said the accused individuals had replaced a criminal sentenced to 20 years in jail by the primary and appellate courts for smuggling 36 kilograms of heroin with another individual jailed for only one year and one month for keeping and using alcohol.

The persecutor went on to say the accused after forging the documents were able to release the smuggler from the prison; however the convict was identified and brought back to the prison by a delegation tasked by the Attorney General’s Office (AGO).

However, Abdul Sabaoor Azar, the defence lawyer for the accused said: “My clients did not falsify the documents, but it was a mistake and the incident wasn’t preplanned.”

Shir Aqa Munib, ACJC’s primary court judge, declaring the decision of the jurists sentenced Gen. Zazai, the ex-Pul-i-Charkhi Prison warden, and all of his associates, to three years in prison over deception and misusing authority.

He said the ruling wasn’t final as the suspects could move the appellate court within the next 20 days. The judge also ordered prosecution of Azizullah Sarbaz, AGO’s representative, Rahimullah Lami, the Afghanistaninfo-icon Independent Human Rights Commission (AIHRC) representative, and Brig. Gen. Pir Mohammad, the National Directorate of Security (NDSinfo-icon) representative, who all have their signatures on the release form of the criminal.

It’s pertinent to mention here that Gen. Zazai is currently superintendent of Herat Central Jail and another convicted suspect --Col. Hashmatullah--is his assistant at the prison.

Pul-i-Charkhi is the biggest prison of the country where more than 10,000 inmates are held.
