Administrative procedure draft law finalized: Naderi

KABULinfo-icon (Pajhwok): The Independent Administrative Reform and Civil Services Commission (IARCSC) on Sunday announced finalizing “the administrative procedure draft law”, saying government services would become fast and transparent once the law is implemented.

IARCSC head Ahmad Nader Naderi, introducing the draft law to different government departments today, said: “Most of our laws in the past only explained responsibilities of citizens about government offices, but those laws had no explanation about the responsibilities of government offices toward citizens.”

He said the commission held long technical discussions with Afghan and foreign experts in areas of administration and legislation in developing the draft law that was finalized and introduced today.

He said the draft administrative procedures law would legalize public administrative operations and addressing complaints of those affected by the administration procedure.

Besides these advantages, the law would also transform the public administration into an accountable and responsive governance and would bring about transparency in operations and expedite administrative affairs, Naderi said.

“This law would also make offices responsible to avoid any kind of action that leads to discrimination, misuse of authority, concentration of services to a specific group or tribe and ethnic and linguistic issues and allows citizens to fight against such issues,” he added.

Nader said under the draft law if a citizen suffered damages, the administration should compensate him.

The law would eradicate challenges currently exist in the administration in the next five years, he said, adding the draft law would be shared with the Cabinet next week for approval.

Meanwhile, second vice-president, Sarwar Danish, said preparation of the administrative procedure law was a great achievement. “If this law and the law of administrative courts are approved, it would lead to great positive changes for the public.”

He stressed on reforms in laws and said: “Reform and reviewing of laws can help us in reaching to the desired goal.”

Danish said vacuum existed in laws regarding administrative rules and fortunately the administrative procedure law contained all needed contents.

Legality, accountability, impartiality and simplification of procedures are main administrative rules well explained in this draft law, he added.

Danish said government organs should offer services in a transparent manner and without any discrimination.

He asked IARCSC leadership to launch a general evaluation of public administrations and said public administrations should be based on modern worldinfo-icon norms in terms of law.
